Scope of application These General Terms and Conditions apply to all orders placed via the POVNOMAD online store, unless expressly agreed otherwise. The offer is aimed at consumers worldwide. 3. Subject matter of the contract POVNOMAD sells digital products in the form of eSIM profiles for the use of mobile data services. They are provided exclusively in digital form by e-mail. 4. Conclusion of contract The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to place an order.By completing the order process, you submit a binding offer to conclude a purchase contract. The contract is concluded with the electronic order confirmation from POVNOMAD. 5. Prices and terms of payment All prices are in Euro and do not include VAT according to §19 UStG (small business regulation).Payment is made via the payment methods offered in the order process: Stripe (incl. Apple Pay, Google Pay, credit card) and PayPal. 6. Delivery The eSIM is delivered exclusively by e-mail to the address provided by the customer. Delivery usually takes place within a few minutes, but within 3 working days at the latest. The customer is also obliged to check the spam or advertising folder of his e-mail inbox. The e-mail with the eSIM is sent from the address service@povnomad.com address. 7. Conditions of use The use of the eSIM requires a compatible, eSIM-capable end device and compliance with the installation instructions. The customer is responsible for checking the compatibility of their device before purchase. 8. Right of withdrawal As this is digital content that is made available immediately after purchase, there is no right of withdrawal (Section 356 (5) BGB). The customer expressly agrees that POVNOMAD may commence performance of the contract before expiry of the withdrawal period and confirms that he/she is aware that his/her right of withdrawal shall expire upon commencement of performance. 9. Warranty and liability POVNOMAD assumes no liability for the functionality of the eSIM in the respective network or for local network availability. In all other respects, the statutory provisions on liability for defects apply. 10. Applicable law German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The contract language is German. 11. Dispute resolution The EU Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/. POVNOMAD is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
